These Terms of Service ("Terms") govern your use of gummi.com.
By using the Services or placing an order with us, you agree to these Terms. If you do not agree, please do not use the Services.
We may update these Terms from time to time. The most current version is always available on this page, and the "Last Updated" date reflects when the Terms were last changed. Where changes are material, we will provide reasonable notice through the Services or by email. Your continued use of the Services after changes take effect means you accept the updated Terms.
Our online store is hosted on Shopify, which provides the e-commerce platform we use to sell our products.
1. Eligibility
To purchase from us, you must be at least 18 years old or the age of majority in your country of residence, whichever is higher. By placing an order, you confirm that you meet this requirement.
You agree to use the Services only for lawful purposes and not to use the Services in any way that violates applicable law.
2. Products and orders
We sell Gummi electrolyte gummies and related products. Product descriptions, images, ingredient information, and prices are provided to the best of our ability and may be updated from time to time. We do our best to display product colors and images accurately, but minor variations may occur due to screen settings and natural variation in food products.
We reserve the right to:
Limit quantities of any product per person, household, or order.
Refuse or cancel orders we reasonably believe are placed for resale, are fraudulent, or violate these Terms.
Correct pricing or product information errors and cancel orders affected by an obvious error, even after the order is placed. If we cancel an order for this reason, we will refund any amount you have paid.
If we cancel or change an order, we will contact you using the email or phone number you provided.
3. Pricing and payment
Prices are shown on the Services and may include or exclude taxes and shipping depending on your location. The final total, including any taxes and shipping fees, is shown at checkout before you confirm your order.
We may change prices at any time, but changes will not affect orders already placed and confirmed.
You agree to provide accurate and current payment and account information. Payments are processed by our third-party payment processors, who handle your payment information under their own terms and privacy policies.
4. Subscriptions
If you sign up for a recurring subscription, you authorize us to charge your payment method automatically at the frequency you selected, until you cancel.
You can pause, skip, or cancel your subscription at any time through your account on our site. Cancellations take effect for future orders. We do not refund orders already shipped due to a missed cancellation, but you can contact us at support@gogummi.com for any specific situation and we will do our best to help.
5. Shipping and returns
Our shipping, returns, and refund terms are set out in our Shipping and Returns Policy, which forms part of these Terms. Import duties, taxes, VAT, and customs fees are addressed in Section 5A.
For EU and UK consumers, your statutory rights under EU and UK consumer law, including the right of withdrawal within 14 days of receiving your order, apply in addition to anything stated in these Terms. Note that for hygiene and product safety reasons, opened bottles of Gummi are not returnable, in line with the right-of-withdrawal exemption for sealed health and food products.
5A. Shipping, import duties, taxes, VAT, and customs
Gummi ships worldwide from our fulfillment partner in China.
Customers act as the importer of record in their country of destination. Your order may be subject to import duties, VAT, taxes, and customs handling fees imposed by your country of destination. These charges are determined by your local customs and tax authorities, are not collected by us, are not included in the price you pay at checkout, and are the sole responsibility of the customer.
We are not responsible for VAT, import duties, customs fees, or any other taxes or charges levied by the destination country. We cannot predict, calculate, or refund these charges.
International shipping times vary by destination and may take 5 to 10 business days. Delivery may be delayed by customs processing, local postal services, or other factors outside our control. We are not liable for shipping delays caused by customs, postal services, or other third parties.
If you refuse to pay import duties or taxes and the package is returned to us, we reserve the right to deduct the original outbound shipping cost and any return-shipping charges from your refund. Orders returned due to incorrect addresses, refusal of delivery, unclaimed packages, or failure to pay customs may be subject to non-refundable shipping costs.
You are responsible for ensuring your shipping address is correct and for understanding the customs and tax rules of your country before placing an order.
6. Health information and product use
Gummi is a food supplement. It is not a medicine and is not intended to diagnose, treat, cure, or prevent any disease. Gummi is not a replacement for drinking water or for a balanced diet and healthy lifestyle.
If you are pregnant, nursing, taking medication, or have a medical condition, consult a healthcare professional before using Gummi. Discontinue use and contact a healthcare professional if you experience any adverse reaction. Keep Gummi out of reach of children.
Information on the Services about hydration, electrolytes, and health is provided for general informational purposes only and is not medical advice.
7. Your account
If you create an account with us, you are responsible for keeping your login information confidential and for any activity on your account. Notify us at support@gogummi.com if you believe your account has been accessed by someone else.
We may suspend or terminate accounts that violate these Terms, attempt to defraud us, or misuse the Services.
8. Intellectual property
The Gummi brand, logo, product names, images, text, and design on the Services are owned by us or our licensors and are protected by intellectual property law. You may not copy, reproduce, distribute, modify, or use any of our content for commercial purposes without our written permission.
You may share product photos and content on social media for personal, non-commercial purposes, and we appreciate it when you do.
9. User-submitted content
If you submit reviews, photos, comments, or other content to us through the Services, by email, or through social media tags, you grant us a worldwide, royalty-free, non-exclusive license to use, reproduce, and display that content for marketing and operational purposes related to Gummi.
You confirm that any content you submit is your own, does not infringe anyone else's rights, and does not contain anything unlawful, misleading, or harmful. We may remove user-submitted content at our discretion.
10. Prohibited use
You agree not to use the Services to:
Violate any applicable law.
Infringe our intellectual property rights or anyone else's.
Harass, threaten, or harm any person.
Submit false or misleading information, including fraudulent orders.
Upload or transmit viruses, malware, or other harmful code.
Interfere with the security or functioning of the Services.
Collect or scrape personal information about others.
Use the Services for any commercial resale of our products without authorization.
We may suspend or terminate your access to the Services for any breach of these prohibitions.
11. Third-party links and services
The Services may contain links to third-party sites or use third-party tools (such as payment processors, shipping carriers, and apps integrated through Shopify). We are not responsible for the content, products, or practices of those third parties. Their own terms and privacy policies apply to your use of their services.
12. Disclaimers and limitation of liability
The Services and products are provided "as is" and "as available." To the maximum extent permitted by law, we do not make any express or implied warranties beyond those required by applicable consumer protection law.
To the maximum extent permitted by law, we are not liable for:
Indirect, incidental, or consequential damages, including loss of profits, loss of data, or business interruption, arising from your use of the Services or our products.
Service interruptions, delays, or errors outside our reasonable control.
Decisions you make based on general information on our site that is not personalized advice.
For EU and UK consumers: nothing in these Terms affects your statutory rights as a consumer under applicable EU, UK, or local consumer protection law. Those rights apply in addition to anything stated here, and if any clause in these Terms conflicts with your statutory rights, your statutory rights prevail.
13. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Gummi and its directors, employees, and partners from any third-party claim arising from your breach of these Terms or your violation of any law or third-party right. This clause does not apply to EU or UK consumers acting outside their trade, business, or profession, to the extent prohibited by applicable consumer protection law.
14. Termination
These Terms apply for as long as you use the Services. You can stop using the Services at any time.
We may suspend or end your access to the Services if you materially breach these Terms, but for ongoing customer relationships we will use reasonable judgment and, where possible, give you notice and a chance to fix the issue.
Sections of these Terms that by their nature should survive termination (including intellectual property, limitation of liability, indemnification, and governing law) will survive.
15. Governing law and jurisdiction
These Terms are governed by the laws of the Netherlands. Disputes will be subject to the exclusive jurisdiction of the competent courts of the Netherlands.
For EU consumers: the above does not deprive you of the protection afforded to you by mandatory provisions of the consumer law of your country of residence. You may also bring proceedings in the courts of your country of residence as permitted by EU consumer law.
For consumers outside the EU/UK: if mandatory consumer protection law in your country of residence applies and conflicts with these Terms, that mandatory law prevails to the extent of the conflict.
16. EU online dispute resolution
If you are a consumer in the EU, the European Commission provides an online dispute resolution platform. You can use this platform to try to resolve disputes with us out of court, although we are not obligated to use it.
17. Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will continue in full effect.
18. Entire agreement
These Terms, together with our Privacy Policy and Shipping and Returns Policy, form the entire agreement between you and us regarding your use of the Services and supersede any earlier agreements or communications between us on the same subject.
